TRANSTORNO DO ESPECTRO AUTISTA:

Concepções, Fundamentos Legais e a Realidade Jurídica no Estado do Amapá

Resumo

O presente artigo discorre sobre concepções, fundamentos legais e a realidade Jurídica no Estado do Amapá do Transtorno do Espectro Autista (TEA). Para tanto, formulou-se como problema de pesquisa: de que forma a legislação nacional e estadual do Amapá regulamentam a proteção jurídica das pessoas com TEA? Foram definidos os seguintes objetivos específicos: compreender as concepções gerais do Transtorno do Espectro Autista; apresentar a proteção inerente ao Transtorno do Espectro Autista no Ordenamento Jurídico; analisar a tutela jurisdicional de proteção ao Transtorno do Espectro Autista no âmbito do Estado do Amapá. Como percurso metodológico se utilizou o estudo hipotético- dedutivo, utilizando as técnicas de pesquisa de revisão de literatura, pesquisas bibliográficas e análise documental, a fim de satisfação dos objetivos os quais este trabalho se propõe a alcançar. Assim, como resultado e conclusão identificou-se que a legislação nacional e estadual do Amapá regulamentam a proteção dos direitos do Transtorno do Espectro Autista, por meio de leis e normas que buscam assegurar a assistência educacional, acessibilidade, participação social, direitos do cotidiano tanto da pessoa com TEA, quanto os familiares e responsáveis amparados, bem como pelas tutelas jurídicas específicas como a Lei nacional nº 12.764/2012 e Lei nacional nº 13.146/2015 que contribuíram para garantias de direitos.

ABSTRACT

This article discusses concepts, legal foundations and the legal reality in the State of Amapá of Autism Spectrum Disorder (ASD). To this end, the research problem was formulated: how do national and state legislation in Amapá regulate the legal protection of people with ASD? The following specific objectives were defined: understand the general concepts of Autism Spectrum Disorder; present the protection inherent to Autism Spectrum Disorder in the Legal System; analyze the judicial protection of protection against Autism Spectrum Disorder within the State of Amapá. As a methodological path, a hypothetical-deductive study was used, using the research techniques of literature review, bibliographical research and documentary analysis, in order to satisfy the objectives that this work aims to achieve. Thus, as a result and conclusion, it was identified that the national and state legislation of Amapá regulate the protection of the rights of Autism Spectrum Disorder, through laws and regulations that seek to ensure educational assistance, accessibility, social participation, everyday rights both of the person with ASD, as well as family members and guardians supported, as well as specific legal protections such as National Law No. 12,764/2012 and National Law No. 13,146/2015 that contributed to guarantees of rights.
